1. Acceptance of Terms

By accessing or using CAVOK, you agree to be bound by these Terms of Service ("Terms"), including the Licensed Application End User License Agreement (“Standard EULA”) provided by Apple. See Here

2. Scope of License

This license granted to you for CAVOK Weather by Tyler Pollard is limited to a nontransferable license to use CAVOK Weather on Apple-branded products that you own or control as permitted by the Usage Rules set forth in the Apple App Store Terms of Service.

3. Disclaimer of Warranties

CAVOK is provided "as is" and "as available," without warranty of any kind. CAVOK Weather disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.

4. Limitation of Liability

To the extent not prohibited by law, CAVOK Weather and its developer Tyler Pollard shall not be liable for any personal injury, or any incidental, special, indirect, or consequential damages whatsoever, including, without limitation, damages for loss of profits, data, business interruption, or any other commercial damages or losses, related to your use of or inability to use CAVOK.

5. User Responsibility

Users must verify the accuracy and reliability of information provided by CAVOK Weather and use it at their own risk.

6. Data Use and Privacy

CAVOK Weather may collect and use data related to your use of CAVOK Weather as described in our Privacy Policy and as permissible under applicable law.

7. Termination

The license is effective until terminated by you or CAVOK Weather. Your rights under these terms will terminate automatically without notice if you fail to comply with any term(s).

8. Intellectual Property

All content in CAVOK Weather is the property of Tyler Pollard or its licensors and protected by copyright laws.

9. Legal Compliance

You must comply with applicable laws regarding the use of the app and not export or re-export CAVOK Weather unlawfully.

10. Governing Law

This agreement is governed by the laws of the jurisdiction where CAVOK Weather is headquartered, excluding its conflicts of law rules.

11. Modifications

CAVOK Weather reserves the right to modify these terms. Continued use of CAVOK Weather after changes constitutes your consent to the changes.

12. Arbitration Agreement

Any dispute or claim arising from or relating to these Terms or your use of CAVOK Weather will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

13. Third-Party Beneficiary

Apple, Inc. and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

14. External Services

CAVOK Weather may enable access to third-party services and websites ("External Services"). You agree to use the External Services at your own risk, and CAVOK Weather is not responsible for examining or evaluating the content or accuracy of these External Services.

15. No Warranty from Apple

In the event of any failure of CAVOK Weather to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for CAVOK to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to CAVOK.

16. Apple's Liability

Apple is not responsible for addressing any claims by you or any third party relating to CAVOK Weather or your possession and/or use of CAVOK Weather, including: (a) product liability claims; (b) any claim that CAVOK Weather fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.
